DYI Divorce? Mediate Then Arbitrate?
Jennifer Keaton
The value of ADR in the family law arena, particularly divorce, is gaining
popularity. What couples may not consider when they are at the start of the process
is how to manage the process.

Med-Arb: Another Unknown Option for Divorcing Folks
Jennifer Keaton
Med-Arb is the Prius of ADR. It is a hybrid and full of promise, efficiencies, and good
mojo. More than that, it is a process that comes with a guarantee of a resolution – one
way or the other – to a dispute.

Making Every Mediation Count
Andy Flink
With every domestic case I mediate I believe that there is always room for progress
regardless of where in the process the mediation occurs. Many times cases are ready
to settle but sometimes they are not. If this is an initial mediation in the case then it
can be a great first step just getting the parties together in the same place.

Workplace Investigations & Email
Jennifer Keaton
We’ve seen the TV shows and movies where a computer forensics expert uncovers
some super secret electronic file or finds the files that “were deleted.” Oftentimes,
uncovering electronic communications that show workplace misconduct do not
require such an expert, rather just a quick search of the email server.

Employers that routinely allow (or expect) employees to be available or to
communicate via email should evaluate whether workplace policies are clear about
the expectations on how employer-provided email is used, not only to be sure that the
employer complies with all laws, but also to ensure that the availability of the email
account is not abused.

been through it. This article is addressed to the parties, as opposed to lawyers. It
explains what mediation is, how parties can make it work to settle disputes, and thus
avoid the nightmare of trial. Forum Discussion

Mediator Neutrality: How is it possible?
Rachel Fishman Green, Esq.
How could a mediator be neutral about your situation when you are getting
divorced? Surely one of you is right and the other is wrong! If you know in your bones
– and all of your friends agree – that you are right, you may think that mediation
would not make sense for you, because you don’t want to compromise. 3 Comments

Filing an Uncontested Divorce in Georgia….
Jennifer Keaton
If you know the rules or know where to find them, the game is not so hard. Often the
law can be that way. With couples that are trying to file their uncontested divorce
themselves, the effort, diligence, and sheer perseverance required to figure out how to
do it can be daunting!
